1. These terms
These terms are an agreement between you and MyClassUp (“we”, “us”) for using the MyClassUp website, admin panel, institute addresses and mobile app (together, “MyClassUp”). By signing in or using MyClassUp you accept them. If you use MyClassUp for an institute, you accept them for the institute too.
Our privacy policy explains how we handle personal data, and our refund and cancellation policy covers payments. Both form part of these terms.
2. Accounts and sign-in
- You sign in with a one-time code sent to your mobile number or email. Keep that number and inbox secure.
- Give correct details, and tell your institute or us if they change.
- You are responsible for what happens under your account. Tell us at once if you think someone else used it.
- Students under 18 may use MyClassUp only with the consent of a parent or lawful guardian.
3. What institutes agree to
An institute that uses MyClassUp agrees that it:
- adds only people it has a genuine relationship with, such as its own students, parents and staff;
- has a lawful reason, and parental consent where needed, for every person’s details it adds;
- owns, or has permission to use, every lesson, video, test and file it uploads;
- is responsible for its teaching, its fees, and what its staff do in MyClassUp; and
- keeps its staff accounts up to date and removes people who leave.
4. Fair use
Nobody may use MyClassUp to:
- upload anything unlawful, abusive, obscene, or that infringes someone else’s rights;
- harass, bully or threaten anyone, or share another person’s details without permission;
- copy, record or share an institute’s lessons or tests outside MyClassUp without its permission;
- try to get into another account or institute, test our security without written permission, or disrupt the service; or
- copy, resell or rebuild MyClassUp itself.
We may remove content or suspend accounts that break these rules, and tell the institute concerned.
5. Who owns what
Your content stays yours. Institutes own their courses, lessons, tests and files. Students own the work they submit. You give us permission to store, copy and show that content only as needed to run MyClassUp for you.
MyClassUp is ours. The software, design, name and logo belong to us. Using MyClassUp does not give you any rights in them beyond using the service.
6. Plans, trial and fees
Institutes can start with a free trial. It begins only when the institute chooses, and no payment details are needed. After the trial, an institute pays the price of its chosen plan, as shown on the pricing page or agreed in writing. Prices are before GST, which is added as the law requires.
Fees are paid in advance for each month or year. If a payment is overdue, we will remind the institute, and after 15 days we may pause access until it is paid. We give at least 30 days’ notice before changing the price of a plan an institute is already on.
Fees that students pay to their institute are a matter between the student and the institute. MyClassUp is not a party to them.
7. Keeping the service running
We work to keep MyClassUp available and fast, and we back up data every day. We sometimes need short breaks for maintenance, which we try to schedule outside class hours and announce in advance. We cannot promise that MyClassUp will never be interrupted, for example by a problem with the internet or a provider we rely on.
8. Ending your use
An institute can stop using MyClassUp at any time, as set out in the refund and cancellation policy. After it leaves, it can export its data for 30 days, after which we delete it.
A student, parent or teacher can stop using MyClassUp at any time and can ask us to delete their account.
We may suspend or close an account that seriously or repeatedly breaks these terms, or when the law requires. Where we can, we will warn the institute first and give it time to fix the problem.
9. Limits of our responsibility
MyClassUp is a tool for running an institute. We are not responsible for the teaching, the accuracy of an institute’s content or marks, or decisions an institute makes about its students.
As far as the law allows, we are not liable for indirect losses, such as lost profit or lost business, and our total liability to an institute for any claim is limited to the fees it paid us in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited under Indian law.
10. Law and disputes
These terms are governed by the laws of India. The courts at Pune, Maharashtra have exclusive jurisdiction over any dispute. Before going to court, please write to us so we can try to resolve the matter together within 30 days.
11. Changes to these terms
We may update these terms as MyClassUp grows. We update the date at the top, and for important changes we tell institutes at least 30 days before they take effect. If you keep using MyClassUp after that, the new terms apply.
